Product Defects and Liability FAQsWhat is Product Liability? It involves injuries or death caused by the use of a product, machine, equipment, automobile, bus or even plane. How do I know if a product was defective in the design or manufacturing? That is a good question and one that takes special skill and experience to answer. Sometimes, common sense is the best indicator on whether a product is defective. You should ask yourself these questions; “Should this have happened?”, “Should the product have performed and failed to perform in the manner that it did?”. What if I no longer have the equipment or device, do I still have a case? Yes. Although preserving the product in the same condition it was in after the injury is very important, not having the product does not necessarily prevent you from making a claim. What if the equipment or device belongs to my employer or a friend? It is very important that you contact an attorney as soon as possible so that they may inform whoever has possession of the product that caused the injury not to alter or destroy it.
